Pursuant to:

* Decree No. 24/2013/NĐ-CP dated 28/3/2013 of the Government to stipulate details about some articles of the Law on Marriage and Family regarding marriage and family involving foreign elements;

* Circular No. 22/2013/TT-BTP dated 31/12/2013 of the Ministry of Justice to stipulate details and guiding implementation for some articles of the Decree No. 24/2013/NĐ-CP dated 28/3/2013.

I. Dossier for marriage registration of a Vietnamese citizen residing in Hanoi with a foreigner

1. The declaration for marriage registration (in the prescribed form).

2. Certification of marital status or the declaration for marriage registration with certification on marital status by people's committee of ward or commune or township where the permanent residence registration (issued not more than 06 months until the day that the Department of Justice received dossier) confirmed that currently he (or she) has no wife (or husband).

3. Certification of competent medical organizations in Vietnam or overseas issued not more than 06 months until the day that the Department of Justice received dossier, to certify this person is not a mental disease or get other diseases which make she (or he) can not be aware, or can not master her (or his) behavior.

4. Notarized copy of ID card or passport.

5. Notarized copy of the family record book or the temporary residence confirmation.

6. Certification for recording in book regarding divorce conducted overseas with respect to Vietnamese citizen who was divorced at foreign's competent authority overseas under the provisions of Circular No. 16/2010/TT-BTP dated 08/10/2010 guiding record in the book regarding divorce conducted overseas.

7. Certification for Vietnamese citizen has been consulted and supported regarding marriage and family involving foreign elements (as defined in Clause 3, Article 6 of Circular No. 22/2013/TT-BTP 31/12/2013).

II. Dossier for marriage registration of a Vietnamese citizen resides abroad and a foreigner.

1. The declaration for marriage registration (in the prescribed form).

2. Certification of marital status issued by the diplomatic representative agency or consular office of Vietnam or the foreign competent authorities where she (or he) resides which issued not more than 06 months until the day that the Department of Justice received dossier, which states that currently he (or she) has no wife (or husband); The Vietnamese resides abroad (with foreign nationality) must submit certificate that issued by competent authority of local country where the citizen bears nationality to prove marital status and the certification of marital status issued by the competent authority of Vietnam.

3. Certification of competent medical organizations in Vietnam or overseas issued not more than 06 months until the day that the Department of Justice received dossier, to certify this person is not a mental disease or get other diseases which make she (or he) can not be aware, or can not master her (or his) behavior.

4. Notarized copy of passport or valid alternative document such as a travel document or residence permit.

5. Certification for recording in book regarding divorce conducted overseas with respect to Vietnamese citizen who was divorced at foreign's competent authority overseas under the provisions of Circular No. 16/2010/TT-BTP dated 08/10/2010 guiding record in the book regarding divorce conducted overseas.

III. Dossier for marriage registration of person with foreign nationality and Vietnamese citizen.

1. The declaration for marriage registration (in the prescribed form).

2. Document proving the marital status of foreigner that issued by the competent authority of country where she (or he) is a citizen, not more than 06 months until the day that the Department of Justice received dossier, certifying that currently the applicant has no husband (or no wife).

In the case of foreign law does not provide for granting a certification for marital status, it is replaced by a certification for his (or her) oath that currently he has no wife (or she has no husband) accordance with the laws of that country.

3. Certification of competent medical organizations in Vietnam or overseas issued not more than 06 months until the day that the Department of Justice received dossier, to certify this person is not a mental disease or get other diseases which make she (or he) can not be aware, or can not master her (or his) behavior.

4. Notarized copy of passport or valid alternative document such as a travel document or residence permit.

5. Permanent resident card or temporary residence card or temporary residence certificate (for foreigners reside permanently or temporarily in Vietnam and marry each other).

6. In the case of a foreigner divorced with Vietnamese citizen at the foreign competent authority he (or she) must submit the certification on record into the book regarding divorce conducted overseas (as defined in Circular No. 16/2010/TT-BTP dated 08/10/2010 guiding record into the book regarding divorce conducted overseas).

Time for settlement: 25 days after the Department of Justice receives a valid dossier, in the case there is a request for police's verification, the term was extended more 10 days.
